Privacy statement

Introduction
1. This privacy statement applies to all personal information given by candidates to USG CAPACITY. In this context Candidate means the person who visits the site of USG CAPACITY, uses the services and/or site of USG CAPACITY and has registered and/or signed up with USG CAPACITY.

2. USG CAPACITY attaches the greatest importance to the privacy of its Candidates and only uses personal information it has been given for the purposes described in this privacy statement and complies with all relevant legislation and regulations concerning the protection of personal information.

3. This privacy statement applies to the registration and processing of all personal information concerning the Candidate which USG CAPACITY in any way receives from the Candidate. The words he/him/his in this Privacy statement are also taken to mean she/his/her.

Details USG CAPACITY
USG CAPACITY is responsible for processing personal data and for the operation of the site www.usgcapacity.nl (including all other internet sites of USG CAPACITY accessible under sublevel domain names related to this domain name). USG CAPACITY is established, with registered offices in Almere, at Landdrostdreef 124, 1314 SK Almere (NL).

Registration
In order to make use of the services of USG CAPACITY (including employment mediation by USG CAPACITY and/or to carry out work via USG CAPACITY) the Candidate is required to register with USG CAPACITY. This can be done on the site of USG CAPACITY, or by personal registration at one of the branch offices of USG CAPACITY.

Persons below 16 years of age require the permission of parents or guardians to register.

Purposes of use
1. The personal information provided by Candidates registering with USG CAPACITY will be processed in order:

a. to register the Candidate and to manage this registration;
b. to check for correctness and comprehensiveness;
c. for the Candidate to use the site and services of USG CAPACITY;
d. to maintain an employer-/employee relationship with the Candidate, and/or enter into/maintain an employment mediation relationship;
e. to (be able to) offer the Candidate work, assignments, training courses and/or training opportunities, career advice and/or other work-related services;
f. to evaluate the Candidate for a particular function or assignment;
g. to advance or encourage the personal development of the Candidate;
h. to bring the Candidate in contact with or introduce him/her to one or more clients or relations of USG CAPACITY;
i. to inform the Candidate (by e-mail, text message, or other means of electronic communication) about the products and/or services of USG CAPACITY. Included here would be matters relating to the services of USG CAPACITY which in our view are important for the Candidate. Such matters would include site updates for USG CAPACITY, new and existing vacancies, events organised by us, training opportunities and other work-related matters;
j. to inform the Candidate about products and/or services provided by partners that have been carefully selected by USG CAPACITY by posting information on our site;
k. to provide this information to natural persons and legal entities associated with USG CAPACITY when and insofar USG CAPACITY regards this to be of importance;
l. to provide this to companies and/or persons that USG CAPACITY has involved to carry out certain tasks.

2. By registering with USG CAPACITY the Candidate grants USG CAPACITY the right to use the information provided on registration for the objectives set out above.

3. The candidate may be offered the opportunity at the time of registration or at some later time, to state that his/her personal information may also be used to inform him/her (e.g.) by e-mail, text message or other (electronic) means of communication concerning products and services, differing from or of a different type from the service offering of USG CAPACITY, including the products and services of carefully selected partners of USG CAPACITY. The Candidate may at any time withdraw the permission granted by him/her by sending an e-mail to info@usgcapacity.nl.

4. In the event that the Candidate's information is used by USG CAPACITY to inform the Candidate (e.g. by e-mail, text message or other electronic means of communication) in regard to services offered by USG CAPACITY, which in the opinion of USG Capacity are of importance for the Candidate, the Candidate may at any time oppose this by sending an e-mail to info@usgcapacity.nl requesting that the information should no longer be used for this purpose.

Provision of information to third parties
1. USG CAPACITY does not provide personal information concerning its Candidates to third parties which are not potential employers, clients and/or to natural persons or legal entities associated with USG CAPACITY, unless and in so far as:

a. USG CAPACITY is so required by law or the information is requested by a governmental institution or another regulatory body;
b. in the opinion of USG CAPACITY this is necessary to protect its rights and/or property (including that of its associated companies) and/or to prevent a crime and/or to protect state security or the security of other candidates;
c. this is carried out in order to verify the comprehensiveness and correctness of the personal information provided;

2. By registering with USG CAPACITY the Candidate automatically grants permission for USG CAPACITY to give his/her information to potential employers and/or clients of USG CAPACITY. He/she also grants USG CAPACITY permission for his/her information to be given to natural persons and legal entities associated with USG CAPACITY insofar as USG CAPACITY regards this as necessary for the meaningful provision of services.

3. After the candidate has specifically given permission to this end his/her information may also be given to third parties, i.e. potential employers, clients and/or natural persons and legal entity associated with USG CAPACITY, if and insofar, in the opinion of USG CAPACITY this is important for a meaningful provision of services.

4. Furthermore, USG CAPACITY may also give its Candidates' information to companies and/or persons who it has involved to carry out certain tasks, including companies and persons based outside the Netherlands, including countries where there is no (extensive) legislation around confidentiality. The above-mentioned companies and/or persons shall only gain access to the personal information of the candidate if this is strictly necessary to carry out the tasks assigned by USG CAPACITY. USG CAPACITY shall require the companies and/or persons involved not to give the personal information of its Candidates to third parties or to use these for any purpose other than that for which this information was received. In addition, USG CAPACITY shall take the necessary measures to ensure the adequate protection of all personal information which is passed on.

Provision of extraordinary personal data
In principle, USG CAPACITY does not process any extraordinary personal information from its candidates unless the Candidate has granted explicit permission or USG CAPACITY is obliged to do so by law or regulations.

Liability
1. USG CAPACITY disclaims all responsibility whatsoever for liability for any possible damages resulting from the use of personal information by employers, clients and/or third parties selected by USG CAPACITY, to whom this information is supplied  with the permission of the candidate. Furthermore, USG CAPACITY is not liable for compliance by these employers, clients and/or third parties with relevant legislation and regulation (including privacy legislation).

2. If and insofar, with the assistance of USG CAPACITY, mutual contact is established between  the Candidate and an employer, client and/or third party (parties) and this contact leads to any contract and/or legal relationship between the candidate and said employer, client and/or third party or parties, USG CAPACITY shall at no time involved as a party.

Security
1. USG CAPACITY makes every possible effort in taking appropriate organisational and technical measures to secure the personal information of its candidates against wrongful processing and/or loss. USG CAPACITY employees, who on behalf of USG CAPACITY, have been given access to the personal data of its Candidates, are subject to a confidentiality clause.

2. Notwithstanding the security measures taken by USG CAPACITY it may transpire that third parties succeed in circumventing these measures and/or in using the personal data of the Candidates of USG CAPACITY for improper purposes. At no time and in no way may USG CAPACITY be held liable for this.

Site USG CAPACITY.nl
1. The site of USG CAPACITY is public and accessible worldwide.

2. Every Candidate can visit the site of USG CAPACITY without giving his/her personal data to USG CAPACITY.

References and links
USG Capacity's site contains references and/or hyperlinks to one or more websites of third parties. USG CAPACITY is in no way liable for the manner in which these third parties comply with the privacy legislation. Hence, USG CAPACITY advises its Candidates to carefully read the privacy policy for the websites of these third parties so that the Candidate is aware of the manner in which these third parties deal with his/her personal information.

Use of log files
The site of USG CAPACITY automatically collects certain unidentifiable information concerning visitors to its site including the Internet Protocol (IP) address of the Candidate's computer, date and time of access to the site, the internet address of the website from which the  Candidate has been linked to the site of USG CAPACITY, the IP-address of the Internet Service Provider of the Candidate, the Candidate's operating system, the parts, information and pages of the site which the Candidate has visited or viewed, together with the material that the candidate forwards or downloads from the site. This technical information is used for the management of the site and to optimise the site and the service offering of USG CAPACITY. This information can also be used for historical, statistical, or scientific purposes. The technical information which is stored may be passed to third parties and may be permanently stored for future use.

Cookies

These advertisements may are offered by third parties who are not under the surveillance of USG CAPACITY. USG CAPACITY is therefore not responsible for these cookies or other technologies present in the advertisements. 3. The Candidate's browser may enable the Candidate to choose to refuse the cookies. However, this can have a negative impact on the use of the USG CAPACITY website.

Right of inspection
The Candidate may, at any time, request USG CAPACITY via info@usgcapacity.nl or by post (USG CAPACITY, Marketing dept., PO Box 1, 1300 AA Almere) to indicate which information concerning him/her is being processed by USG Capacity.

1. Furthermore, the Candidate may at any time request USG Capacity via the aforementioned procedure to add, correct, or remove information relating to him/her.

2. USG CAPACITY shall answer the Candidate's request within four weeks.

Questions, comments, and complaints
In the event that the Candidate has questions, comments or complaints regarding this Privacy statement and the manner in which USG CAPACITY registers, utilizes and processes his/her information, he/she can notify USG CAPACITY via info@usgcapacity.nl or post (USG CAPACITY, Marketing dept., PO Box 1 1300 AA Almere).

Ending registration and duration of storing details
The candidate can end his/her registration at any given moment by sending an email to info@usgcapacity.nl or by personally deregistering at the branch office. In that case, USG CAPACITY shall terminate the registration within four weeks.

Adjustment Privacy statement and withdrawal of approval
USG CAPACITY has the right to adjust this Privacy statement at any given time. The most recent Privacy statement is always viewable on the USG CAPACITY website.

If the candidate wishes to end his/ her given approval concerning the contents of this Privacy statement, he/she may do so by sending an email to unfo@usgcapacity.nl. Withdrawing approval may lead to the candidate being unable to use the services and/or website of USG CAPACITY.

Notification with the Dutch Data Protection Authority (CBP)
USG CAPACITY has made notification of its processing with the Dutch Data Protection Authority (CBP).
